ʻSub contractorʼ is Butlers Epoxy Flooring Pty Ltd.
ʻPrinciple contractorʼ is person (or other legal entity) who has entered into a contract with Butlers Epoxy Flooring Pty Ltd or referred to as a ʻsubcontractor.On acceptance of quotation and/or requisition for works to be carried out the principle contractor is deemed to have entered into a payment schedule with the sub contractor as set out on quotation. Works will not be started until deposit is received, non-payment of full amount will result in warranty being void.
Any collection charges, legal expenses and commissions incurred in attempting to recover payment shall be payable by the principle contractor.The sub contractor warrants that works are carried out according to specifications and requirements as quoted and/or in accordance with Australian standards for epoxy flooring applications and will be subject to warranties by Butlers Epoxy Flooring Pty Ltd for the time period of 2 years against defective materials and/or installation of the product.
Extended warranty can be negotiated as requested and agreed upon Warranty does not cover accidental damage, wear and tear or abuse or neglect in cleaning procedure by principle contractor.Without prejudice to any other rights the sub contractor may have, the principle contractor shall indemnify the sub contractor for any loss damage or expense incurred by the sub contractor should the principle contractor breach any terms of a contract or cancel any order or part of any order after acceptance by the principle contractor.
On floor applications, where pre-existing floor wastes are in position, no responsibility will be taken for falls to be within required dispersal area. It is the responsibility of the principle contractor to make any needed adjustments and/or installation before floor applications are carried out.
The sub contractor may/may not advise on needed adjustments where foreseen.The contractor shall not be liable for breakdown or applied floor/wall systems if cleaning, care and maintenance advice have not been adhered to. This may be given in either written or verbal form. It is the responsibility of site owners where floor systems are in place to discern such guidelines before cleaning, and maintaining.
Cracking or dislodgement of our installed flooring caused by external factors outside of our control such as subterranean or structural movement, collision and abuse are not covered or implied by our warranty.Any clerical errors in computation, typing or otherwise of any quotation, invoice or specifications given by the sub contractor shall be subject to correction by the sub contractor and notified to principle contractor.
